The Lessee agrees to use the equipment only for and in accordance with its intended use and pursuant to and instructions and warnings provided therewith. Loss or damage to the equipment is the responsibility of the Lessee. The Leaser makes no warranty, express or implied, as to the merchantability of the equipment, its fitness for the particular purpose for which it is used, or its state of repair. In no event will the Lessor be responsible for any damage, loss or injury caused by or arising out of the use of any equipment supplied hereunder, or the failure of te equipment to function as intended. Lessee’s sole remedy under this lease is refund of the lease price. Lessor will not be responsible for any incidental or consequential damages arising from the lease of the equipment. It is the Lessee’s responsibility to examine the equipment prior to use to determine fitness and state of repair and to return the equipment in the same state of repair and cleanliness as when delivered. Under no circumstance is equipment to be moved once installed by Tots Around Town, Inc.Customer “Lessee”
